Premise: effectiveness of the General Conditions of Sale

These general conditions of sale (hereinafter, "General Conditions of Sale") have as their object the regulation of the purchase of products and services, carried out remotely and made available, via the internet, from the site www.gluppa.it (hereinafter, the Site) in compliance with the Italian legislation on distance contracts (Legislative Decree 70/2003).

The site is owned by POPUP STUDIO SOC. COOP. (hereinafter POPUP STUDIO) with registered office in Località Collepaganello 28 / A, 60044 Fabriano (An), PI and CF 02795520424, REA AN 215580.

The Customer is required, before sending the order, to carefully read the General Conditions that have been made available on the Site to allow them to be reproduced and stored.

Contracts concluded with POPUP STUDIO through the site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian.

Choose and order the Products

The characteristics and the price of the various products are shown on the page relating to each Product.
To purchase the Products, the Customer must add the Product to the "Cart", enter the shipping and billing information, select the desired payment method and after having read the General Conditions and the Privacy Policy, confirm the order. At this stage you can choose whether to register and create an account on the site, or whether to make the purchase without registering.

By confirming the order, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these transcribed General and Payment Conditions.
The contract stipulated between POPUP STUDIO and the Customer must be considered concluded with the acceptance of the order by POPUP STUDIO. This acceptance is communicated to the Customer through an email confirming the order.

If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Italian legislation on distance contracts.

Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance or evasion, even partial, of an order.

POPUP STUDIO promotes the responsible consumption of alcohol and excludes any responsibility at its own expense in the event of a purchase made by children under 16 years of age.

Product Information

Information relating to products that can be sold at a distance is available, with the relative product codes, on the site. Products without the "add to cart" button or with the button disabled are not available for purchase.
The visual representation of the products on the site normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics but differ in color and size. In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails.

Prices

The prices of the products are without application of VAT pursuant to art. 1, cc 54 - 89, law 190/2014 - Flat-rate regime, without application of withholding tax as an advance payment. All prices are expressed in Euros.

Shipping to Italy

The customer can choose whether to receive the product with a standard or express shipping. The standard shipping cost of a Gluppa in Italy is € 8.00 including VAT. The cost of express shipping in Italy for a Gluppa is € 10.00 including VAT.

Shipments to countries of the European Union

The cost of shipping to European Union countries varies according to the country of destination, increasing in proportion to the increase in the weight of the products ordered. When the Customer selects a specific European country of destination, the shipping costs will be automatically updated.

Shipments to non-European Union states

The shop does not automatically accept requests for shipping to non-EU countries. Write to info@gluppa.it to finalize the purchase and plan shipments for these destinations.

Terms of payment

The Customer will be able to pay the price of the Products and the related delivery costs through PayPal and credit card and prepaid through PayPal.

PayPal, credit card and prepaid

Once the order is confirmed, the Customer will be redirected to the PayPal site, where he can make the payment with his account or using a card, even prepaid. The site will only consider orders whose payment has been successful. In case of cancellation of the order by the Customer or in case of non-acceptance of the same by POPUP STUDIO, the amount will be refunded directly to the Customer's account.
The circuits on which it is possible to purchase on the Paypal Site are: Mastercard, Maestro, Visa, Visa Electron, American Express, Aura, Discover.
To ensure maximum security, the Customer will carry out the payment transaction directly on PayPal's secure servers. The Site NEVER stores the Customer's credit card data.

Confirmation of receipt of the order

The Customer receives, upon execution of the contract, an email confirming receipt of the purchase order sent. The communication contains a link to this document, the order number, the summary of the shipping and billing data, the list of products ordered with their essential characteristics, their price.

Transport and shipping

The Products purchased on the site will be sent to the address indicated by the Customer during the purchase procedure. For administrative reasons, orders paid by “Pay Pal” will be sent to the address indicated in the payment receipt as the “Shipping address”.
POPUP STUDIO issues an invoice for the goods shipped from the order placed on the Site, and sends it to the Customer in digital format via email only if expressly requested by the customer in the NOTES field of the payment form (check out). For the issuance of the invoice, the information provided by the Customer during the purchase procedure is valid. It will not be possible to make any changes to the invoice after it has been issued.

Shipping costs, except where otherwise indicated, are charged to the customer and are clearly highlighted during the purchase procedure.
All purchases will be shipped via the Italian Post Office or other carrier (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays. POPUP STUDIO is not responsible for unforeseeable delays.
Once the shipping label has been filled in, the Courier will send the Customer a confirmation email which will include a link to refer to for tracking the shipment. POPUP STUDIO schedules shipments generally one day before collection, therefore the link will become active only after the data has been updated by the Courier after the actual acceptance of the package.

Any damage or problem arising from the shipment will be handled directly by POPUP STUDIO and without consequences for the Customer provided that upon receipt of the obviously damaged package (ex: broken, opened or ruined) it is accepted with reserve, declaring verbatim to the carrier "I accept goods delivered with reserve "and demanding written indication of reports addressed to the carrier on the presence of dents and / or on the number of different packages and / or on the partial opening of the package or any other obvious and evident damage on the delivered product.
Otherwise POPUP STUDIO, in spite of itself, will not be able to replace the goods damaged due to transport and the Customer will lose the right to replacement and / or refund.

The Customer is invited and obliged to carefully examine the physical goods materially received-delivered, especially with regard to the indications on labeling (ingredients, allergens, origin, expiry date, weight, format, etc.) and any other element which proved to be decisive in the choice of purchase of the asset.

Delivery time

The delivery of goods available in stock generally takes place (except for Calabria and the Islands) in 4 working days in the case of standard delivery, and 2 working days in the case of express delivery, excluding periods close to Christmas, Easter and holidays. summer. For shipments to the Islands and Calabria, 2 additional days are to be considered at the normally scheduled times. POPUP STUDIO does not assume responsibility for any delay in delivery, does not accept reminders or requests for early shipping.
POPUP STUDIO, however, reserves the right to communicate to the customer the unavailability, even temporary, of the Products. In case of such communication, the Customer will have the possibility to choose one or more alternative products. In the event that the Customer decides not to choose alternative products or to cancel the order, POPUP STUDIO will refund any sums already paid by the Customer within the same time frame.

Main delivery services active both in Italy and in the European Union

ITALIAN POST "sda"
The service provides for the delivery of goods up to 30 kg in 3/4 working days, (in 5/6 days for the Islands and Calabria), from Monday to Friday, Saturdays and holidays excluded, for home delivery. It is possible to make shipments throughout the national territory.

POST ITALIANE "Crono Express"
The service provides for the delivery of goods up to 30 kg in 1/2 working days (Monday to Friday, Saturdays and holidays excluded, for home delivery). It is possible to make shipments throughout the national territory.
For the Crono and Crono Express services there are 2 delivery attempts at the address indicated at the time of the order; the second delivery attempt is made the business day following the first attempt. In the event of a second unsuccessful delivery attempt, the Courier will leave a notice of stock with the references of the Post Office where the recipient can collect the shipment in the next 10 working days, including Saturday, which run according to the terms indicated on the 'Notice of stock. During these 10 days the Customer can contact the Courier directly to arrange the return or to change the address of the same. For information regarding the initial cost of opening the storage procedure and for any additional cost for redelivery, refer to the amounts published on the website www.poste.it .; since these costs are attributable to the absence of the recipient, they will be fully charged to the Customer.

POSTE ITALIANE "International Chrono"
The service provides for the delivery of goods up to 30 kg with delivery in approximately 4 working days for destinations within the European Union. There are one or two delivery attempts depending on the country of destination and the delivery will in any case be carried out according to the procedures of the postal operator of destination. The number of delivery attempts foreseen for each country is specified in the Country Fact Sheets published on the website www.poste.it. In case of absence of the recipient, a notice of non-delivery is left to the recipient showing the date and time of the delivery attempt, the office where the shipment is stored and the term of storage. The storage service is free. After the delivery attempts foreseen for each country, the shipment is held in storage by the postal operator of the country of destination generally for 15 days, including Saturdays and holidays. Upon expiry of the storage period, the uncollected shipment will be returned to the sender.

Right of withdrawal

Pursuant to art. 64 and ss. of the Consumer Code (Legislative Decree 2005/206), the customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. To exercise this right, the customer must send POPUP STUDIO a communication within 14 days from the date of receipt of the goods.
This communication must be sent by registered letter with return receipt, addressed to:

The POPUP STUDIO Customer Service will, once received the communication, communicate to the customer the instructions on how to return the goods.
The right of withdrawal is subject to the following conditions:
1. The law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product.
2. By law, the shipping costs for returning the goods are charged to the customer.
3. The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer.
4. POPUP STUDIO is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.
5. In case of damage to the goods during transport, POPUP STUDIO will notify the customer of the incident (within 5 working days), to allow him to file a complaint against the courier and obtain any refund. In this case, the product will be made available to the customer for its return at the same time canceling the request for withdrawal.
POPUP STUDIO will refund the customer the full amount already paid, within 30 days from the return of the goods, by means of a reversal procedure of the amount charged to the credit card.
The right of withdrawal is totally lost, due to lack of the essential condition of integrity of the property (packaging and / or its contents), in cases where POPUP STUDIO ascertains:
1. The lack of the external packaging and / or wrapping containing the purchased product
2. Damage to the product for reasons other than its transport.
In case of forfeiture of the right of withdrawal, POPUP STUDIO will return the purchased good to the sender, charging the shipping costs to the sender.

Return

POPUP STUDIO intends to provide Customers with the possibility of replacing the purchased Products.
The Customer who is not fully satisfied must keep all the documentation relating to the delivery and the Product itself in its original packaging and contact POPUP STUDIO by sending an email to the address info@gluppa.it or by calling the following number: +39 3515548028 Mon-Fri 9.00 - 15.00. POPUP STUDIO Customer Service will agree with the Customer to collect the Product.

In case of lack of conformity of Products sold by POPUP STUDIO, the Customer must immediately contact the email address info@gluppa.it. To assert the legal action, you are asked to attach photos of damaged or non-compliant products / goods to facilitate the resolution of the problem.
The Customer has the right to replace the non-compliant goods or to a suitable reduction in the price or to terminate the contract. The Customer loses these rights if he does not report the lack of conformity to POPUP STUDIO within two months from the date on which he discovered the defect.
The mere variation of the graphic design of the product does not constitute a lack of conformity and / or defect of the product, being a right of the manufacturer.

Mistakes

The information relating to the Products provided through the Site is constantly updated, however it is not possible to guarantee the complete absence of errors.
POPUP STUDIO reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update information at any time without prior notice.

Applicable law and competent court

The sales contract between the customer and POPUP STUDIO is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his / her municipality of residence or elective domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of Ancona.
